Terms and Conditions:
Thank you for choosing King Koi USA. We are committed to providing high-quality products and services to our customers across the US, Hawaii, Alaska, Canada, and Puerto Rico. To ensure a smooth and satisfactory experience for both parties, please review and agree to the following terms and conditions:
Refund Policy: If you receive a shipment of dead fish (Dead On Arrival), you must file a claim with the carriers. To be eligible for a refund or replacement with another fish with same value, you must contact us within 2 hours of delivery with clear photos or video evidence of the dead fish in the unopened bag. After 2 hours, we will not accept any refund requests.
Return Policy: All sales are final for LIVE stock. We do not accept returns if you receive a shipment of koi pond supplies, pond equipment and/or koi accessories that is not as described or is defective, we offer a full refund or exchange. You must contact us within 24 hours of delivery with clear photos or video evidence of the issue. The item must be returned in its original packaging within 7 days of delivery.
Cancellation Policy: You may cancel your order before it has been shipped. However, we cannot accept cancellations once your order has been shipped.
Shipping Policy: We ship our fish using reliable shipping carriers to ensure the safety and well-being of the fish. We ship to the continental US, Hawaii, Alaska, Canada, and Puerto Rico. Shipping charges are calculated based on the shipping address and the order size.
Orders: a.Orders can be placed online, by phone, or in person at our local fish shop; b.We require full payment at the time of ordering. We accept all major credit cards and PayPal; c. We do not offer any credit or payment plans and d.Shipping costs will be calculated based on the destination and weight of the order.
Shipping: a. We use various shipping carriers and methods, depending on the destination and size of the order; b. We will provide you with a tracking number once your order has shipped; c. While we do our best to ensure timely delivery, we cannot be held responsible for any delays or issues caused by the shipping carrier and d. We do not ship to P.O Boxes.
Live Arrival Guarantee: a. We guarantee that all live fish will arrive alive and healthy. However, we cannot be held responsible for any issues caused by mishandling, weather conditions, or transportation delays; b. If you experience any problems with the live fish upon arrival, you must notify us within 2 hours of receipt; c. We may require photographic evidence of the issue; d. We will either replace the fish or issue a refund for the purchase price and e. We reserve the right to refuse any claims that do not meet our live arrival guarantee conditions.
Returns and Refunds: a. All sales are final for LIVE stock. We do not accept returns; b. We accept returns or refunds for dry goods within 7 days of purchase, as long as the item is unused and in its original packaging; c. We do not refund shipping costs and d. All returns and refunds are subject to approval by King Koi USA.
Legal Compliance: a. By placing an order with King Koi USA, you certify that you are legally allowed to own and receive the fish in your state or country. We are not responsible for any legal issues related to the ownership or transportation of the fish; and b.Regarding the ownership and transportation of the fish, it is your exclusive responsibility to adhere to all applicable federal, state, and local laws and regulations.
Limitation of Liability: a. We at King Koi USA will not be responsible for any losses that result from using or not using our goods, including but not limited to lost earnings, lost savings, or consequential damages; and b. Our responsibility is limited to what you paid for the item.
Governing Law: a. The laws of the State of California will govern these terms and conditions and be used for any disputes between the parties; and b. The parties agree that the state and federal courts situated in Los Angeles County, California, have exclusive jurisdiction over any dispute arising out of or related to these terms and conditions.
Product Availability: a. We strive to maintain accurate inventory levels on our website, but we cannot guarantee the availability of all products at all times; b. If an item you ordered is temporarily out of stock, we will let you know as soon as possible and provide you with the option of a refund or a similar item; and c. We reserve the right to limit the quantities of any product or cancel any order at any time.
Intellectual Property a. All content on the King Koi USA website, including but not limited to logos, images, and text, is protected by copyright and other intellectual property laws; and b. You may not copy, distribute, or use any content from our website without our prior written consent.
Force Majeure: If natural disasters, strikes, or governmental actions prevent King Koi USA from meeting its duties hereunder, King Koi USA will not be held responsible for the delay or inability to meet such obligations.
Modification of Terms: a. Without warning, King Koi USA may alter these terms and conditions at any moment; and b. By continuing to use our website and place orders with us, you agree to be bound by the updated terms and conditions.
Governing Law and Jurisdiction: The parties agree that: a. the laws of the USA will apply to and govern these terms and conditions; and b. any litigation arising from or relating to these terms and conditions will be brought exclusively in the state or federal courts.
Severability: Any provision of these terms and conditions deemed illegal or unenforceable will not affect the validity or enforceability of any other provision.
Entire Agreement: Together with our Privacy Policy and any other policies or agreements referenced herein, in no way will you find any additional terms or conditions applicable to your use of this site or the purchase of any items from King Koi and Goldfish other than here.
Waiver: a. The failure of King Koi USA to enforce any provision of these terms and conditions shall not be deemed a waiver of such provision or any other provision.
Assignment: a.Without King Koi USA ‘s prior written agreement, none of your rights or responsibilities herein may be assigned or transferred by you; and b.King Koi USA may assign or transfer these terms and conditions or any of its rights or obligations without your consent.
